Debtor Financial Advisor
We support the full lifecycle of a Chapter 11 process – negotiating debtor-in-possession financing, executing asset sales, confirming a Plan of Reorganization, and providing analytical support, strategy, and expert testimony.
We also get into the nitty-gritty, such as preparing for filings and adhering to court and United States Trustee Program reporting requirements.
In this role, we…
Create unbiased quantitative and qualitative operational and financial assessments.
Compile information needed for a bankruptcy petition.
Prepare all schedules, including the Statement of Financial Affairs.
Develop cash collateral models with in-depth analyses of underlying values.
Negotiate protection payments and provide declarations in support of cash collateral hearings.
Facilitate and guide lender/creditor negotiations.
Manage valuations/appraisals for secured creditor claims and valuation hearings.
Market assets and manage due diligence for Section 363 sales.
Construct “fully loaded” financial projections, operating plans, and “best interest” tests to confirm a Plan of Reorganization.
Solicit support for the Plan of Reorganization using quantitative, rational analyses.
Prepare monthly operating reports for the Office of the U.S. Trustee.
Reconcile creditor claims.
Restructurings are not the time to climb the learning curve. We have been tested many times, across a wide range of businesses and industries.
We gain a holistic understanding of each business to build a tailor-made – often creative – restructuring strategy.
We reduce friction
The process is often contentious. We understand the stressful and adversarial reality debtors face and help to prepare our clients for hazards, reduce friction between parties, and devise productive solutions.
A proven ability to identify productive solutions in challenging situations and offer value-creating strategic advice to firms across a wide range of industries.
